TERMS AND CONDITIONS

These Terms and Conditions, henceforth referred to as 'Terms', outline the framework that governs the interactions between Swazibet Ltd, operating as eBet, and individuals who engage with its services. Among various provisions, these Terms specify critical aspects regarding the conditions under which customers can create and manage their betting accounts with eBet. They also detail the limitations and terms that will regulate the interactions between the parties involved, along with the myriad betting products and services offered by eBet. Therefore, it's crucial for you to thoroughly read and comprehend these Terms and consent to them prior to setting up an account with eBet.

  1. ELIGIBILITY TO BET

1.1. No individual is permitted to apply for an account, place bets with eBet, or enforce any claims related to such bets unless that individual -

  1. is a human being (corporate entities such as companies or close corporations are ineligible to engage in betting);

  2. is at least 18 years of age;

  3. has accurately filled out the entire account application form and has received acceptance from eBet as a valid account holder;

  4. is not registered on the exclusion list as outlined in section 14 of the National Gambling Act of 2004, and

(v) does not violate these Terms and Conditions.

1.2. Any individual who submits an account application form acknowledges that they have read, understood, and accepted these Terms as well as all relevant Rules pertaining to betting on sports events or other acceptable contingencies that may be published on this Site intermittently. By doing so, they are essentially requesting eBet to

  1. establish an agreement under these Terms for providing betting services related to sports, sporting events, and any other lawful occurrences for that individual (hereafter referred to as 'the Customer');

  2. for the aims of this point (i), to initiate a betting account in the Customer's name,

this application shall be considered approved, and the account shall be recognized as established, provided eBet notifies the Customer or accepts any bets after receiving the completed application form.

2. ACCOUNT OPENING PROCEDURE AND RELATED DETAILS

2.1. The Customer guarantees that all information supplied in their completed account application form is accurate and will continue to be true. The Customer is obligated to inform eBet promptly and in writing about any changes that could affect an approved application, including any modifications to their identifying or contact information, credit status, legal standing, or continued eligibility as a customer.

2.2. eBet -

reserves the right to -

  1. accept an application for a new account;

  2. has the right to decline any application for a new account for any reason it sees fit.

  3. may decide at its sole discretion to stop accepting bets from any Customer for whatever reason, without a duty to disclose that reason to the Customer or anyone else, and

  1. will refuse a new account application if -

    1. the account application form has not been completely filled out, and/or

    2. the information provided in the account application form is incorrect or lacks crucial details, and/or

    3. any required information accompanying the application form or requested by eBet is not submitted in the format or timeline specified.

2.3. The Customer is solely responsible for securely maintaining and properly utilizing all account details and any other information necessary for placing bets. The Customer pledges that they will -

  1. not apply for or maintain more than one account with eBet;

  2. not apply for an account on behalf of someone else;

  3. solely use their account for betting purposes, and

  4. not allow any other individual to place bets using their account number, username, or personal identification number provided by eBet over time.

As such, eBet cannot be held liable for fulfilling any transactions linked to any account that was improperly obtained or maintained, nor will it disburse winnings for bets placed in that manner. The Customer agrees to indemnify eBet from any claims, losses, or damages resulting from such bets.

2.4. The Customer agrees to promptly inform eBet if their account information is compromised, lost, stolen, or accessed by someone other than themselves, or if they have any reason to suspect that such situations have occurred. The Customer will be financially responsible for all bets made with eBet and any transactions prior to notifying according to this clause.

2.5. Once a business relationship has been established, an account will be opened in the Customer's name, and the Customer must log in to their eBet account using their personal login credentials, which includes a unique username and password.

2.6. Should there be any discrepancies between the information entered by the Customer while logging in and what was provided when initially creating the business relationship, access to their account will be denied until the Customer contacts eBet for assistance.

3. FICA COMPLIANCE

3.1. eBet must adhere to the guidelines set forth in the Financial Intelligence Centre Act, Act 38 of 2001, amended ('FICA'), which outlines the protocols for identifying and verifying customers, conducting due diligence, monitoring transactions continuously, retaining records, and other related matters. These measures are crucial in ensuring that the betting services brought forth by licensed bookmakers like eBet are not misused for money laundering or financing terrorism and other unlawful acts.

3.2. Where FICA and its related regulations mandate certain procedures or restrictions, eBet will comply with those requirements. If FICA does not specify a procedure or restriction, eBet will institute its measures to foster sound corporate governance and socially responsible betting practices, always adhering to applicable legislation. www.fic.gov.za .

3.3. In a retail environment, if a customer -

(i) places a bet of SZL5,000 or more in a single wager, or

(ii) claims winnings totaling SZL5,000 or above,

eBet is obliged under FICA to verify and confirm that customer's identity before processing the transaction.

(i) Full names;

3.4. For online interactions, eBet is mandated by FICA to identify and authenticate every Customer prior to creating a betting account for them. As a part of the registration process, applicants need to disclose various personal and related details, including:

(iii) Residential Address;

(iv) E-mail Address;

(ii) Swaziland Identity Number or Passport Number;

(v) Contact numbers (mobile and/or landline), and

(vi) The source of the funds intended for the betting account.

3.5. An account will not be set up until the identity of the applying Customer is conclusively authenticated and verified by eBet.

3.6. The following measures will be taken by eBet concerning a Customer who must provide proof of identity and residential address:

(i) When a Customer presents their identification document (ID or passport) in person, eBet will photocopy the document on site, verifying it as an accurate copy, which will be documented and stored for record-keeping purposes.

(ii) If an identification document is sent to eBet via facsimile or any type of electronic mail, those documents must be current (not expired in the case of passports) and certified as accurate copies of the original.

  1. (iii) A driver's license may be accepted as a valid identification, provided that:

  2. The Customer cannot present an ID Document for justifiable reasons as recognized by eBet;

  3. The driver's license is valid (not expired), and

  • A photograph of the bearer;

  • The license must display -

  • The date of birth of the bearer, and

  • The Identity Number of the bearer.

The full name (or initials and last name) of the holder;

  1. (iv) Utility bills or similar documents used as proof of a residential address must not be older than three (3) months prior to submission to eBet.

By submitting the online application form for a betting account, the Customer agrees and gives unequivocal consent for eBet to conduct all necessary identification, credit verification, and security checks (including validation of the source of funds) as required by applicable laws, regulatory bodies, or the governing authority. The Customer also consents that during the account holder period with eBet, their identifying information and related particulars can be shared with third-party service providers, including identity verification agencies, cellular network operators, financial institutions, credit bureaus, and governmental agencies.

The Terms and Conditions laid out herein (referred to as 'Terms') define the framework of interaction between Swazibet Ltd, operating under the name eBet, and its clientele. Among other details, these Terms articulate crucial stipulations regarding the circumstances under which an individual can create and manage a betting account with eBet. They also outline the limitations and regulations that govern the relationship between both parties and the diverse betting offerings provided by eBet. Therefore, it is imperative to thoroughly review these Terms to ensure you comprehend and agree to them before creating an account with eBet.

1.1. Individuals wishing to open an account or engage in betting with eBet, as well as enforce any debts resulting from their bets, must meet the following criteria -

  1. must be a real, individual person (entities such as corporations, partnerships, or other business forms are not allowed to bet);

  1. must fill out the account application form completely and accurately, receiving approval as an account holder from eBet;

  1. must not appear on the exclusion list referenced in section 14 of the National Gambling Act of 2004, and

must not violate any of these Terms and Conditions.

1.2. By filling out the account application form, the individual confirms that they have read, understood, and accepted these Terms, along with all Rules regarding betting on sports events or other permissible occurrences that may be published on this Site at any time; such action will be viewed as an application for eBet to

enter into a contractual agreement under these Terms to provide betting services for sports, sporting events, and other lawful activities to that individual (hereafter referred to as 'the Customer');

for the purpose of paragraph (i), to create a betting account under the Customer's name,

this application will be considered approved, and the account established, once eBet communicates this to the Customer or accepts subsequent bets after receiving the completed application form.

2. PROCESS OF OPENING AN ACCOUNT AND RELEVANT DETAILS

2.1. The Customer guarantees that all information submitted in their account application form is accurate and will remain so. They must immediately and in writing inform eBet of any changes or details that could impact an accepted application, including changes to identifying or contact information, credit standing, legal capacity, or their ongoing eligibility as a customer.

eBet retains the right to refuse an application for a new account for any reason it sees fit;

it may also choose to stop accepting bets from a Customer at its discretion, without any obligation to disclose the reason to the Customer or anyone else, and

may reject a new account application if -

the account application form is incomplete, or

the information on that form is incorrect or has significant omissions, or

any required supplementary information that eBet requested in connection with the application is not provided in the format or timeframe specified.

  1. 2.3. The Customer is fully responsible for maintaining the confidentiality and appropriate use of all their account information, which is essential for placing bets. They agree that they will -

  2. not hold or apply for more than one account with eBet;

not open an account for or on behalf of others;

5. PROCEDURE FOR PLACING BETS

only use their account personally for betting activities, and

not allow anyone else to place bets, directly or indirectly, using their account details, username, or PIN provided by eBet from time to time.

Consequently, eBet will not be liable for any transactions related to any accounts improperly held or applied for or for any winnings pertaining to any bets placed under such accounts. The Customer agrees to indemnify eBet against any claims, losses, or damages resulting from such betting activities.

2.4. In case the Customer’s account information is lost, stolen, misused, or accessed by someone not authorized, they must inform eBet immediately. The Customer will be responsible for all bets made and any payments to/from eBet regarding transactions carried out on their account before such notification is received per this clause.

2.5. Once a relationship is established with a Customer, an account will be created in their name. The Customer must log into their eBet account using their personalized credentials, including a unique username and password, to participate in betting transactions.

2.6. If there is any discrepancy between the details entered by the Customer while logging in and those originally provided to eBet when establishing the relationship, access to the account will be denied, and the Customer will need to contact eBet for help.

3.1. eBet adheres to the regulations set forth in the Financial Intelligence Centre Act, Act 38 of 2001, as amended ('FICA'), which outlines the necessary identity verification procedures, customer due diligence, transaction monitoring, record retention, and related matters. These protocols are designed to prevent licensed betting companies like eBet from being exploited for money laundering, financing terrorism, or engaging in other illegal activities.

3.2. If FICA or its associated regulations designate specific procedures or restrictions, eBet will follow these. In the absence of such specifications from FICA, eBet will enact its own procedures and restrictions (as long as they comply with applicable laws) to foster effective corporate governance and responsible betting. 3.3. In retail settings, eBet must establish and confirm the identity of Customers who -

(i) place a bet of SZL5,000 or more at once, or

  1. (ii) claim winnings of SZL5,000 or above,

  2. before processing the transaction, as required by FICA.

will not be recognized by eBet.

3.4. In the online context, eBet must first establish and verify the Customer's identity before legally creating a betting account. As part of the registration process, potential account holders must provide the following personal details:

(ii) Swaziland Identity Number or Passport Number;

(v) Mobile or landline telephone number(s), and

6. PAYMENT BY THE CUSTOMER

(vi) the source of funds intended for the betting account.

  1. 3.5. No account will be established unless eBet has conclusively confirmed the identity of the Customer who requested it.

  2. 3.6. eBet will follow these procedures regarding Customers needing to prove their identity and residential address:

  3. (i) If a Customer presents their ID or passport in person, eBet will make a photocopy at the venue and verify that it is a true copy of the original, which will be kept in records.

(ii) If an ID is sent to eBet via fax or email, it must be current (in case of passports) and certified as a true copy of the original.

(iii) A driver's license may also serve as proof of identity if at least one of the following conditions is met:

The Customer cannot provide an ID for valid reasons accepted by eBet,

The driver's license is current (not expired), and

  1. The driver's license displays -

  2. The full name or initials and surname of the bearer;

(iv) Documents like utility bills used to prove residential address must be dated within three (3) months prior to submission to eBet.

By filling out our online betting account form, the Customer confirms and irrevocably agrees that eBet is authorized to conduct any identification, credit, or other verification procedures, including screening for the source of funds. The Customer further consents that during the entire period for which they hold an account with eBet, their identifying and other relevant information may be shared with third-party service providers, including but not limited to identity verification agencies, cellular network providers, financial institutions, credit bureaus, and governmental bodies.

In order to comply with our responsibilities under FICA, customers might need to provide eBet with a copy of their identification documents during the registration phase or at any time while maintaining a betting account. This requirement includes a valid and readable form of ID or passport, a proof of residence such as a recent statement or invoice from a municipal source or bank (in cases of mortgage properties), and verification of bank account details through statements issued no earlier than three months prior. eBet will inform the customer of the specific documents needed. If the customer fails to supply these documents by the deadline set by eBet, the following consequences will occur:

7. PAYMENT TO THE CUSTOMER

(i) if required during registration, the registration process will be halted, and no betting account will be established until the customer satisfies the document requirements, or

(ii) if requested at any stage after account creation, it will lead to the temporary suspension or deactivation of the betting account until the necessary documentation is provided, or a permanent cancellation of the account if the customer fails to comply.

During the registration, customers will be invited to select a unique username along with a secure password for their betting account.

8. RECOVERY OF AMOUNTS DUE TO eBet

Once all the necessary verification steps are completed successfully, the betting account will be set up, and eBet will send an email to the customer to confirm the creation of their account.

  1. eBet is obligated to report any single cash transactions that exceed SZL24,999.99 to the Financial Intelligence Centre (FIC).

  1. Additionally, eBet must report to the FIC if -

  2. (i) there are any unusual or suspicious transactions, or

  1. (ii) if transactions are associated with individuals suspected of committing or intending to commit offenses outlined in the Protection of Constitutional Democracy against Terrorist and Related Activities Act of 2004.

8.2. eBet shall not -

  1. eBet holds the authority to suspend accounts that do not fulfill FICA standards.

  1. be responsible for -

    1. At any time, eBet may request customers to present a physical or digital copy of their identification documents, smart cards, passports, or proof of residence.

    2. 4. BETTING OPTIONS AND EVENTS

  1. 4.1. eBet reserves the right to choose the events and markets available for betting; however, it is specified that -

(i) multiple bets are not permitted if the result of one bet impacts another. If a customer mistakenly or purposely places a wager on interrelated outcomes within a multiple bet, that bet will be invalidated, and the stake refunded;

(ii) placing multiple bets consisting of different selections from the same event will be classified as interrelated outcomes, for example, betting on the Stormers to win a semi-final and also to win the Tournament, and

(iii) any multiples pertaining to the same team or participants will be considered related outcomes.

4.2. eBet may establish minimum and maximum stakes for betting on different markets, generally or on a case-by-case basis. It is up to the customer to verify whether these limits apply before placing a bet.

4.3. eBet can set limits on the minimum or maximum potential winnings or losses for customers on bets ('stop wins' and 'stop losses') as well, either generally or for particular instances. Customers must check the applicable limits for the market before wagering.

4.4. At its discretion, eBet might allow customers to place bets during a specific event ('in-running betting'), provided that -

eBet cannot accept in-running bets on events part of a series of events taking place over time, and

if the event is not broadcasted, in-running bets will not be available.

9. WITHDRAWAL

4.5. The spreads offered by eBet will be determined periodically at the sole discretion of the company. Customers should inquire about the current spreads prior to betting.

5.1. Customers will place their bets online, or using the mobile betting platform, by telephone through the number that eBet provides occasionally, or via other electronic means that eBet may make available.

5.2. Regardless of the source or physical location of a call or electronic signal for betting, any transaction between eBet and the customer will only be valid if the bet has been accepted by an eBet employee at a licensed location or through software operating from that licensed premise. Every bet will be deemed as placed at the licensed establishment.

5.3. eBet has the exclusive right to accept or reject any bet requested, or any part of it.

  1. 5.4. The customer agrees that any phone conversation or electronic communication associated with any placed bets may be recorded by eBet, with recordings retained as long as deemed necessary. The customer understands that these recordings are kept in compliance with legal requirements and may be utilized by eBet for resolving disputes or other legitimate purposes.

  2. 5.5. It is the customer's responsibility to ensure that their bet is accurately placed and logged by eBet. eBet will provide confirmation of bets as required by law or reasonably requested by the customer.

  3. 5.6. Bets will be accepted by eBet during regular South African business hours and at other times considered appropriate by eBet.

  4. 5.7. The customer must ensure that they thoroughly understand the rules regarding the market in which they intend to place a bet.

5.8. By placing a bet, the customer acknowledges their agreement to the Rules specified by eBet and these Terms.

5.9. Although eBet strives for complete accuracy in announcing, publishing, and issuing prices, off-times, and results, it does not take responsibility for any mistakes that occur and reserves the right to amend any such errors as it sees fit. The customer agrees to indemnify eBet from any losses—whether potential, actual, direct, or indirect—that might arise from such errors.

5.10. Any bets claimed to have been placed that are not -

recorded or confirmed through eBet's betting terminals or wagering software, or

verified by voice recording devices,

5.11. The moment a bet is accepted will be considered as when it has been logged on eBet's betting terminals or wagering software.

5.12. Any bet accepted after the official starting time of the event will be deemed invalid, with no effect. Bets placed on outcomes already known at the time will be voided if it's a single bet. For multiple bets, the bet will remain valid, excluding the odds for the voided event.

5.13. eBet may introduce additional or new betting markets occasionally. Customers are responsible for reading and accepting the relevant 'Market Rules' related to those new markets before placing any bets.

10. ADJUSTMENTS AND CREDIT LIMITS

6.1. Within the account application, the customer will indicate their intention to bet against -

a cash deposit made to eBet by the customer through electronic funds transfer confirmed by a bank-generated document or email reflecting the amount and the customer’s account number;

11. PROOF OF INDEBTEDNESS

a cash deposit made physically into eBet’s banking account, which must be validated by proof of transfer including the customer's reference to eBet, or

a cash amount that eBet will draw as a deposit from the customer’s credit card account.

6.3. The customer acknowledges that the deposit mentioned in Clause 6.1 will serve as security for any financial liabilities that may arise for the customer in relation to eBet.

6.4. Under no circumstances should the customer place a bet that, when combined with any other outstanding bets, surpasses their credit limit with eBet, or the actual cash deposited (after adjustments for taxes, winnings, and losses at the time of the bet). It is the customer's responsibility to confirm that their credit balance or cash deposit can cover the bet they intend to place.

6.5. In case of a technical error or for any other circumstance, if eBet accepts a wager as mentioned in Clause 6.4, it has the option to either honor that wager or refund the stake before, during, or after the event's outcome, without considering any potential winnings. Additionally, eBet reserves the right to adjust the maximum stake allowed without notifying the Customer, ensuring that it remains within the confines of the applicable credit limit or deposit amount.

6.6. When eBet accepts a wager exceeding the established credit or deposit limits, this does not nullify its rights -

to demand payment from the Customer for all sums (including losses) resulting from that bet, or

to later enforce the appropriate deposit restrictions.

6.7. eBet will continuously deduct amounts from the Customer's betting account for any accepted wagers.

6.8. Deposits made via credit card must be under the name of the cardholder, which should align with the name on the eBet betting account.

6.9. The Customer has the right to add to any cash deposit mentioned in Clause 6.1(i) whenever they see fit.

7.1. eBet will routinely credit the Customer's account with any winnings and refunds resulting from their bets.

7.2. eBet will not pay interest on any deposits held.

7.3. If funds are mistakenly credited to the Customer's account, the onus is on the Customer to promptly inform eBet of this error. If eBet has not communicated otherwise, any betting activities conducted by the Customer after the error will be considered null and void.

8.1. If the Customer’s account has a negative balance due to accepted bets surpassing the credit or deposit limit, the Customer must pay eBet the outstanding amount within three (3) business days of a written payment request.

This can be done either -

by directly depositing the necessary amount into eBet's banking account, ensuring the Customer's account number is included on the deposit slip, along with submitting a copy of this slip to eBet, or

by giving eBet written permission, in the required format, to recover the owed amount from the Customer's credit card issuer.

In no situation will eBet be accountable if the Customer's card issuer denies a claim made by eBet for funds owed. Any disputes with the credit card company will not absolve the Customer's responsibility to eBet for payments, and the Customer cannot instruct eBet to reverse a payment already sent to the credit card company.

This also includes any issues, errors, or delays with electronic funds transfer systems or credit card processing equipment that arise from factors outside eBet's control, or any damages or losses the Customer may incur as a result.

8.3. eBet can reclaim funds from Customers under specific circumstances, including, but not limited to:

13. TAXES AND LEVIES

(i) if there is a negative balance in the Customer's account due to mistakenly accepted bets exceeding the allowed limits;

14. TERMINATION

(ii) if eBet has wrongfully credited an account because of an incorrect bet resolution, and the Customer has already utilized part or all of that amount;

  1. (iii) if eBet has inaccurately distributed funds to an account and the Customer has spent part or all of those funds; or

  2. (iv) if the Customer has placed a wager in violation of the Terms and subsequently spent the adjusted amount, leading to a negative balance.

8.4. eBet reserves the right to decide how Customer payments should be applied towards outstanding amounts owed to it.

8.5. If bets are placed using funds that were mistakenly credited to a Customer's account, eBet holds the right to void those bets and cannot be held liable for any losses incurred as a result.

15. BREACH

8.6. Regardless of other provisions within this document, eBet is entitled to offset any sum the Customer owes against any funds available in the Customer's betting account or utilize any secured assets held by eBet to settle any outstanding debts owed by the Customer.

9.1. eBet will consistently credit the Customer with winnings and refunds related to their bets.

9.2. Customers can request to withdraw funds from their eBet betting account, given that the minimum withdrawal amount is SZL. (Swaziland Lilangeni in words) or a higher figure determined by eBet at intervals, which will be transferred to a designated chequing, savings, or credit card account upon the Customer's request via a completed Request for Electronic Transfer of Funds Form available on eBet's website.

9.3. The Customer is fully responsible for ensuring the accuracy of the information provided in any Request for Electronic Transfer of Funds Form, and by signing this form, they guarantee its correctness. eBet will not be liable for transferring any requested amounts based on incorrect data supplied by the Customer.

9.4. Upon receiving a properly filled out Request for Electronic Transfer of Funds Form, eBet will -

conduct necessary checks to confirm that the requested amount is available for transfer after accounting for any necessary deductions or adjustments;

  1. if the requested funds are unavailable, eBet will inform the Customer in a manner deemed appropriate that the request has been declined;

  2. if available, within 24 hours of confirming the amount, eBet will execute the electronic transfer from the Customer's eBet account to their specified account. For clarity, eBet will be deemed compliant with this obligation as soon as they instruct their bankers to complete the transfer, and the 24-hour timeframe does not include any additional time required for the funds to appear in the Customer's bank account.

and eBet will reduce the balance in the Customer's eBet betting account by the transferred amount.

16. RESTRICTIONS ON BETTING

9.5. Withdrawal amounts will exclusively be sent to a South African bank account in the Customer's name.

9.6. eBet may delay any withdrawal request if the Customer has any outstanding debts to eBet.

9.7. Before processing any withdrawals, eBet may require the Customer to upload proof of their banking details issued by their respective bank. When necessary, eBet may conduct online banking verification to verify that the withdrawal account belongs to the Customer.

9.8. eBet may ask for a valid form of identification before any withdrawals are processed, such as a valid ID, passport, driver’s license, or another acceptable identification method. This might cause a slight delay in processing. eBet retains the discretion to decide which identification forms will be accepted. If a Customer has deposited via credit cards or Instant EFT or requested a withdrawal to be made to a credit card, eBet may require images of both the front and back of the respective card.

9.9. Subject to clauses 9.7 and 9.8, eBet will handle withdrawal requests on the next business day after they are submitted. For instance, any requests made before midnight on a Monday will be processed the following Tuesday, while any requests between Friday and Sunday night will be addressed the next Monday. 9.10. Any sum transferred to the Customer's bank account by eBet as per this Clause may have a waiting period before the funds are accessible to the Customer. 9.11. The Customer may not utilize any free bets, bonuses, or winnings mistakenly credited to their betting account, and in such instances, eBet may annul any transactions made by the Customer using those funds and/or withdraw the relevant amounts directly from the Customer's account, either during the transactions or whenever eBet becomes aware of the mistake. 6.5. In the event of a technical issue or due to any other circumstances, if eBet accepts a wager as outlined in Clause 6.4, the company reserves the right to either validate the wager or to return the Customer's initial stake without considering any potential winnings, either before, during, or after the outcome is determined. Furthermore, eBet may place limits on wager sizes without prior notice to the Customer to maintain adherence to the established credit or deposit thresholds.

17. VOID BETS

6.6. Should eBet accept a wager that exceeds the customer's credit or deposit limit, this action does not imply that eBet forfeits any rights, including the right to collect all debts (including losses) stemming from that wager, or to enforce the necessary deposit limits at any future time.

6.7. Regularly, eBet will deduct funds from the Customer's betting account for any accepted wagers.

6.8. Only the individual whose name appears on the credit card may make deposits using that card, and it must match the name associated with the Customer's eBet account.

6.9. The Customer has the right to add funds to any cash deposit referenced in Clause 6.1(i) at any time they choose.

7.1. Continuously, eBet will credit the Customer's account for any winnings and refunds accrued from placed bets.

  1. 7.2. No interest will accrue on any funds deposited with eBet.

7.3. If funds have been incorrectly credited to a Customer's account, it is the Customer's responsibility to promptly inform eBet of the mistake. If eBet has not informed otherwise, any subsequent betting transactions made by the Customer after the error will be considered void.

8.1. If the Customer's account shows a negative balance due to a wager being accepted that exceeds the credit or deposit limits, they must pay the outstanding amount to eBet within three (3) business days after receiving a written request for payment, either by:

directly depositing the required amount into eBet's bank account, making sure to include the Customer's account number on the deposit slip; and

sending a copy of the deposit slip to eBet, or

by providing eBet with written authorization, in a format specified by eBet, to retrieve the necessary amount from the Customer's credit card company.

In any circumstance, eBet shall not be liable to the Customer if the credit card provider declines any claim submitted by eBet regarding the Customer's card. Disputes of any kind between the Customer and the credit card provider will not absolve the Customer of their obligation to eBet for payments made, and they cannot instruct eBet to cancel any payment request already processed with the credit card company;

any disruptions, errors, or delays related to any electronic funds transfer system or other credit card processing equipment or their associated networks caused by factors outside eBet's control, or

any losses, damages, or expenses the Customer may incur as a result, and

eBet is not responsible for any losses or damages that arise from unauthorized data access or incorrect information transmitted through an electronic funds transfer system or any other credit card processing apparatus or network.

8.3. eBet reserves the right to reclaim amounts from Customers under various conditions, including but not limited to:

(i) if a negative balance appears on the Customer's account due to the wrongful acceptance of a wager beyond the permissible limit reflected in their account;

19. ERROR

(ii) if eBet mistakenly credited the Customer’s account due to incorrect bet settlement, and the Customer has spent some or all of that incorrectly allocated amount;

(iii) if eBet improperly distributed funds to a Customer's account, and the Customer has used any portion of that misallocated amount; or

(iv) if the Customer placed a wager in violation of these terms, and later modifications have caused them to spend part or all of the adjusted balance, resulting in a negative account situation.

8.4. eBet may determine the method by which Customer payments will be assigned towards any owed amounts at its discretion.

8.5. In instances where bets were placed using funds that had been incorrectly credited to the Customer’s account, eBet reserves the authority to cancel such bets and cannot be held responsible for any losses experienced by the Customer as a result.

8.6. Regardless of any conflicting terms outlined, eBet is entitled to offset any amounts owed by the Customer against any funds available in the Customer's betting account or to realize any collateral held by eBet and utilize the proceeds to cover any debts owed by the Customer to eBet.

20. LIMITATION OF LIABILITY

9.1. eBet continuously credits the Customer's betting account with all winnings and refunds related to their placed bets.

  1. 9.2. Customers can request the withdrawal of funds available in their eBet betting accounts, with a minimum withdrawal amount of SZL (Swaziland Lilangeni), or any higher amount as determined by eBet from time to time. Withdrawals should be made to a designated chequing, savings, or credit card account by filling out the Request for Electronic Transfer of Funds Form, accessible on eBet's website, and submitting it in the manner specified by eBet.

  2. 9.3. The Customer is fully responsible for the accuracy of the details provided in any Request for Electronic Transfer of Funds Form and, with their signature, guarantees its correctness. eBet will not accept any liability for payments made to any bank accounts based on inaccurate information supplied by the Customer.

9.4. Upon receiving a completed Request for Electronic Transfer of Funds Form, eBet will:

conduct any necessary investigations to confirm that the requested amount, after making all relevant deductions or adjustments, is available for transfer from the Customer's eBet account to their designated banking account;

if the requested sum is unavailable, notify the Customer in a manner deemed appropriate that their request has been denied;

should the requested sum be accessible in the Customer's eBet account, eBet will complete the electronic transfer of the specified amount within 24 hours of confirming that it is available for transfer to the Customer's designated bank account; it is important to note that eBet must be considered compliant with its obligation to effect the transfer at the moment the instruction to the bank is given. The 24-hour window does not cover any additional time that may pass before the selected amount appears in the Customer's bank account, and

will promptly reduce the Customer's eBet betting account balance by the amount that has been transferred.

20.7. eBet shall not be responsible for -

9.5. Withdrawn amounts will only be sent to banking accounts located in South Africa that are registered in the name of the Customer.

9.6. Any withdrawal request made by a Customer can be delayed by eBet until all outstanding amounts owed by that Customer are settled.

9.7. Before processing any funds out of the betting account, eBet may request the Customer to submit proof of their banking account details, issued by the respective bank. If needed, eBet may conduct an online banking verification to ensure that the account designated for withdrawals is indeed the Customer's account.

9.8. Prior to processing any withdrawals, eBet may ask the Customer to provide valid identification, such as a current ID document, passport, driver's license, or another form of acceptable identification. Due to these verification processes, there might be a slight delay in withdrawal processing. eBet retains the right to decide which forms of identification are acceptable. If a Customer has made deposits through credit cards or Instant EFT, or if they request a withdrawal to be deposited to a credit card or cheque account, eBet may require images of both the front and back of the relevant card.

9.9. Subject to Sections 9.7 and 9.8, eBet will endeavor to process withdrawal requests on the business day following the request date; thus, all requests received before midnight on a Monday will be processed on Tuesday of that same week, while those made between Friday and midnight on Sunday will be handled the following Monday.

9.10. Any funds transferred into the Customer's bank account by eBet under this Clause may need a clearance period before they become available for the Customer's use.

9.11. Any free bets, bonuses, or winnings erroneously credited to a Customer's betting account cannot be utilized, and eBet reserves the right to invalidate any transactions made by the Customer with such funds and/or retract the relevant amount from the Customer’s betting account, whether at the point of transaction or later upon discovering the error.

22. DISPUTES

6.5. In the event of a system error or any other issue that leads to eBet accepting a wager as mentioned in Clause 6.4, eBet has the discretion to either fulfill the bet or reimburse the Customer's stake without considering any potential winnings. This decision can be made before, during, or after the event related to the bet. Additionally, eBet reserves the right to limit any stake without prior notice to the Customer, ensuring that the deposit or credit limit is within bounds.

6.6. Should eBet accept a wager that exceeds the established credit or deposit limits, it does not waive its right to collect from the Customer any outstanding amounts, including losses, incurred from such a bet, nor does it forfeit the ability to enforce appropriate deposit limits at a future date.

6.7. eBet will continuously deduct from the Customer's betting account for any wagers accepted by the platform.

6.8. Deposits made via credit card are strictly limited to the cardholder whose name appears on the card, which must align with the name registered on the eBet account.

6.9. Customers are permitted to add to their cash deposits as outlined in Clause 6.1(i) at any moment they choose.

7.1. eBet will periodically deposit winnings and refunds into the Customer's account due to bets made over time.

7.2. No interest will be generated on any deposits held by eBet.

7.3. If the Customer's account is mistakenly credited with funds, it is the Customer's responsibility to promptly inform eBet of the error. Unless stated otherwise by eBet, any bets placed after the error will be considered void.

8.1. If the Customer’s account has a negative balance due to a wager exceeding the credit or deposit limits, the Customer must pay eBet the owed amount within three business days after receiving a written payment demand, either by transferring the necessary funds directly into eBet’s banking account or by providing eBet with written authorization for eBet to collect the amount from the Customer’s credit card provider.

23. EXCLUSION FROM BETTING ACTIVITY

In any circumstances, eBet cannot be held accountable if the Customer's credit card provider declines to meet a claim made by eBet. Any disputes with the credit card provider do not alter the Customer’s obligation to make payments to eBet.

This encompasses any delays, failures, or malfunctions of electronic funds transfer systems or credit card processing equipment that are outside of eBet’s control, including any resulting damages or losses suffered by the Customer.

24. GENERAL TERMS & CONDITIONS

8.3. eBet is authorized to retrieve funds from Customers for various reasons, including but not limited to: (i) debits arising from incorrect acceptance of wagers over limits; (ii) erroneous credits to a Customer’s account that have been withdrawn or spent; (iii) mistakenly allocated funds that have been used by the Customer; or (iv) bets placed in violation of these Terms that result in negative account balances.

8.4. eBet holds the discretion to determine how payments made by Customers are applied towards any owed amounts.

8.5. If bets are placed with funds that were erroneously credited to the Customer's account, eBet reserves the authority to cancel such bets without being liable for any resultant losses.

8.6. Regardless of the content here, eBet has the right to offset any due amounts against any available funds in the Customer’s account or to liquidate any collateral held by eBet to settle outstanding debts from the Customer.

9.1. eBet will continuously credit the Customer's betting account for all winnings and refunds related to bets that have been placed.

9.2. Customers can request withdrawals of any credited funds, as long as the requested minimum amount complies with eBet’s set standards, and transfers occur to a designated checking, savings, or credit card account after completing an Electronic Transfer of Funds Form available on eBet's website.

9.3. The Customer is entirely liable for the accuracy of the information provided in the Electronic Transfer of Funds Form. By signing it, the Customer guarantees this information is correct. eBet has no responsibility for erroneous payments made to any bank accounts based on inaccurate Customer details.

9.4. Upon receiving a duly filled Electronic Transfer of Funds Form, eBet will conduct an inquiry to confirm that the requested amount is payable from the Customer’s account after any necessary deductions. If the requested funds aren't available, eBet will inform the Customer; if they are, eBet will proceed with the transfer within 24 hours, although the actual deposit time may vary and will not be counted within the 24-hour window.

9.5. Withdrawals must be directed only to a bank account based in South Africa that belongs to the Customer.

9.6. eBet may hold back any withdrawal requests pending the Customer’s settlement of any outstanding debts.

(i) a credit bureau;

(ii) any bank or regulatory agency, or

  1. any other person or entity,

9.7. Before processing any withdrawal, eBet can ask the Customer to upload proof of their bank account details from the relevant financial institution. eBet may also conduct online verification to confirm that the withdrawal account is indeed in the Customer's name.

9.8. Prior to executing withdrawals, eBet might request the Customer to provide valid ID documentation, such as a current ID card, passport, driver's license, or other acceptable forms of identification. These requirements may lead to some delays in processing the withdrawals, and eBet reserves the right to choose which identification formats it will accept. If deposits were made through credit cards or Instant EFT, eBet could require copies of both sides of the relevant card.

9.9. Subject to the previously mentioned requirements, eBet aims to process withdrawal requests on the next business day, meaning any requests received before midnight on a Monday will be completed by Tuesday, while those made over the weekend will be processed the following Monday.

9.10. Any funds transferred to the Customer’s bank account might have a clearance period before becoming accessible to the Customer.

9.11. Any promotional bets, bonuses, or winnings credited to a Customer’s account in error are not to be utilized, and eBet maintains the right to invalidate any transactions that utilized such funds, reclaiming the relevant amounts whether at the moment of transaction or after recognizing the error.

9.12. The maximum withdrawal limit is set at SZL 15,000.00 per day, and this does not include any jackpot payouts, which will be processed manually.

10.1. eBet retains the right to modify or revoke the credit limit assigned to any Customer at its discretion.

10.2. Regardless of any other provisions stated here, eBet is empowered to offset any outstanding amounts owed by the Customer with any balances available in the Customer's accounts or to liquidate any collateral held by eBet to satisfy any debts owed by the Customer.

11.1. For the purposes of these terms, a statement signed by an eBet director, manager, assistant manager, trader, or accountant (whose status need not be verified) indicating the amount owed by the Customer to eBet will be considered sufficient proof of such debt.

12. MONITORING BETTING ACCOUNT ACTIVITIES

12.1. eBet is not only permitted but also legally required to oversee all customer betting account activities to identify any irregularities, illegal actions, or suspicious account management practices. Any discovery of such activities may lead to the immediate closure of the Customer's betting account.

25. REFUND POLICIES

12.2. eBet holds the authority to withhold payouts or declare bets invalid, as well as terminate a Customer's betting account if there's substantial evidence of -

(i) the Customer exploiting bugs, glitches, or errors within the eBet betting services available through the website ('the Services');

(ii) the Customer employing bots or similar AI technology;

by sending an email to

(iii) any hacking, assaults, or misuse of the Services or its underlying systems;

(iv) the Customer using VPNs or similar tools to bypass geographical restrictions relevant to the Services;

26. BETTING RULES & PROCEDURES

(v) the Customer engaging, assisting, or facilitating any form of criminal or fraudulent activities;

(vi) any doubts concerning the integrity of the events on which bets were placed;

(vii) any improper manipulation of odds concerning events that were wagered on;

(viii) incidents of match rigging, collusion, cheating, or any other unethical behaviors, and/or

(ix) if the Customer is barred from participating in betting due to employment contract terms, legal constraints, or regulations from the relevant sports governing bodies.

12.3. Ensuring System Integrity and Fair Use

12.3.1 User Responsibilities: Users must promptly report any glitches, defects, or bugs within the system ('System Errors') to eBet upon discovery. Not reporting or attempting to exploit System Errors for personal benefit is deemed a breach of these terms.

12.3.2 Ban on Exploitation: Using System Errors to gain any kind of advantage, especially financial, is explicitly forbidden. Such behavior undermines the integrity of eBet's platform and creates an unjust environment for all participants.

12.3.3 Reporting Violations: Should eBet suspect a user of not reporting or intentionally exploiting System Errors, the user will be notified and their account may be temporarily suspended while an investigation is carried out.

12.3.4 Investigative Rights: eBet has the right to scrutinize any user's activities and impose penalties if violations of the System Integrity and Fair Use Policy are identified.

12.3.5 Legal Recourse and Compensation: Users discovered to have abused System Errors for their advantage will face legal action. Furthermore, eBet will pursue restitution for any fraudulent gains and recover costs associated with investigating the misconduct.

12.3.6 Account Closure: eBet has the right to instantly terminate any user's account if found to be in violation of these terms, without prior warning or compensation.

12.3.7 Changes to Terms: eBet reserves the authority to alter these terms at any moment. Should a user continue to utilize the platform after such alterations, it indicates acceptance of the revised terms.

13.1. All winnings are subject to taxes and levies mandated by provincial authorities. eBet will deduct these taxes and levies and remit them on behalf of the player.

14.1. Before accepting any wager, eBet reserves the right to either temporarily suspend or permanently terminate the provision of betting services to a Customer without needing to provide justification. In case of such suspension or termination -

eBet will refund the Customer any remaining balance held by eBet after deducting losses, winnings, and taxes once those funds are available in eBet's banking account;

any outstanding debts the Customer owes to eBet will become immediately due.

14.2. The Customer can terminate their relationship with eBet using written notice at any time following the completion of any betting transactions and after settling all debts owed to eBet. eBet will refund the Customer's remaining deposit balance within a reasonable timeframe post-termination, subject to adjusting for any losses, winnings, and taxes.

14.3. eBet will not accept any more bets from a Customer who has had their service terminated under these Terms unless the Customer submits a new application which is then approved by eBet.

15.1. If the Customer violates any of these Terms and fails to rectify such violation within 48 hours after receiving a written notice from eBet, eBet reserves the right to terminate the contractual agreement with the Customer and void any bets placed by that Customer, whether accepted or not, and/or seek damages. In this case -

(i) all amounts due to eBet from the Customer will be immediately payable; and

(ii) eBet will retain a lien over all Customer funds deposited with eBet until any damages are settled.

15.2. Without limiting the above, the Customer is considered in default if -

(i) they engage in any insolvency act;

(ii) their estate is declared bankrupt;

any attempts to collectively negotiate with their creditors;

the Customer's name appears on the list of excluded individuals specified in section 14 of the National Gambling Act, 2004.

15.3. The Customer will be responsible for covering any legal fees (including attorney-client scale costs, collection expenses, and tracing fees) along with any governmental taxes such as value-added tax, incurred by eBet in the process of recovering overdue amounts or enforcing any of its rights against the Customer due to a breach of these Terms.

16.1. Directors, employees, partners, or affiliates of eBet are prohibited from betting or holding an account with eBet.

16.2. Individuals involved in events for which eBet offers betting cannot place any bets on such events.

16.3. Any bets that violate Clauses 15.1 or 15.2 will be deemed void and will be cancelled.

27. Promotional Terms
16.4. 'Syndicate Betting' is completely banned by eBet. This refers to any scenario where a group collaborates to place a bet or series of bets on the same event or market. eBet retains the right to invalidate all bets associated with such Syndicate Betting and to withhold winnings while an investigation is conducted.

16.5. The standard payout limits for winnings range from SZL 5,000.00 to SZL 15,000.00 per day for each customer, depending on management decisions. Jackpot games have distinct payout limits, allowing only one payout for a customer per draw.
